Welcome to SHIFT Fiji. These Terms & Conditions govern your access to and use of the SHIFT Fiji website, mobile applications, services, listings, profiles, reviews, rankings, advertising products, featured placements, events, content, communications, and related services.

By accessing or using SHIFT Fiji, you agree to be bound by these Terms & Conditions, our Privacy Policy, Disclaimer, Refund Policy, Safety & Listing Verification Policy, Reviews & Leaderboard Policy, and Advertising & Featured Listings Policy.

If you do not agree with these Terms, you must not use the platform.

1. About SHIFT Fiji

SHIFT Fiji is a digital property marketing, advertising, networking, and information platform designed to connect property owners, agents, agencies, developers, investors, buyers, tenants, service providers, and other participants within Fiji's property industry.

SHIFT Fiji is not a real estate agency, broker, property manager, legal advisor, financial advisor, lender, conveyancer, surveyor, valuer, or party to any property transaction unless expressly stated in writing.

Any property sale, purchase, rental, lease, service engagement, or business arrangement occurs solely between the relevant parties.

2. Eligibility

Users must be at least 18 years of age and legally capable of entering into binding agreements.

If you create an account or act on behalf of a business, agency, developer, or organisation, you warrant that you have the authority to bind that entity to these Terms.

3. User Accounts

Users are responsible for maintaining the confidentiality of their account credentials and all activities conducted through their account.

Users agree to provide accurate and current information and to update information when required.

SHIFT Fiji reserves the right to suspend, restrict, or terminate accounts at any time where false information, fraud, misuse, policy breaches, security concerns, or legal risks are identified.

4. Property Listings

Users submitting property listings warrant that:

  • They have authority to advertise the property.

  • All information provided is accurate and current.

  • All photographs, videos, plans, and documents are owned by them or used with permission.

  • The listing complies with all applicable laws and regulations.

Users are solely responsible for the accuracy and legality of all listing content.

SHIFT Fiji does not independently verify every listing and makes no guarantee regarding the accuracy, legality, ownership, condition, availability, pricing, title status, zoning, development approvals, or suitability of any property.

Users must conduct their own due diligence before entering into any transaction.

5. Agent, Agency and Business Profiles

Agents, agencies, developers, service providers, and businesses are responsible for ensuring all profile information remains accurate and current.

SHIFT Fiji may request verification documents, licensing information, proof of authority, business registration documents, or other supporting information at any time.

Users acknowledge that profile information is self-submitted and may not always be independently verified by SHIFT Fiji.

6. Verification Services

SHIFT Fiji may provide verification badges or verification indicators for users, businesses, agencies, developers, listings, transactions, or other platform features.

Verification indicates only that certain information has been reviewed by SHIFT Fiji at a particular point in time.

Verification does not constitute:

  • A guarantee of ownership.

  • A guarantee of legality.

  • A guarantee of licensing compliance.

  • A guarantee of financial capacity.

  • A guarantee of safety.

  • A guarantee of professional competence.

  • A guarantee of future conduct.

  • A guarantee of transaction success.

Users remain responsible for conducting their own investigations and due diligence.

7. Reviews, Ratings and Testimonials

SHIFT Fiji may allow users to publish reviews, ratings, testimonials, feedback, and comments.

Users warrant that all reviews submitted:

  • Reflect genuine experiences.

  • Are truthful to the best of their knowledge.

  • Are not misleading.

  • Do not contain defamatory content.

  • Do not contain harassment, threats, abuse, discrimination, or unlawful material.

SHIFT Fiji reserves the right to review, edit, moderate, reject, remove, restrict, or disable any review at its sole discretion.

Reviews represent the opinions of individual users and do not necessarily reflect the views of SHIFT Fiji.

SHIFT Fiji does not guarantee the accuracy, fairness, completeness, or reliability of reviews.

8. Leaderboards and Rankings

SHIFT Fiji may provide rankings, leaderboards, awards, badges, scores, ratings, and performance indicators relating to agents, agencies, businesses, service providers, listings, or other users.

Users acknowledge and agree that:

  • Rankings are generated using proprietary algorithms and methodologies.

  • Rankings are informational only.

  • Rankings do not constitute endorsements.

  • Rankings do not constitute professional certifications.

  • Rankings do not constitute factual statements regarding performance.

  • Rankings may change at any time without notice.

  • Rankings may include data provided by users or third parties.

SHIFT Fiji does not guarantee the accuracy, fairness, completeness, or reliability of rankings.

Users waive any claim against SHIFT Fiji relating to leaderboard positions, rankings, ratings, scores, visibility, reputation, or related platform features.

9. Featured Listings and Advertising

SHIFT Fiji may offer paid advertising products including featured listings, sponsored content, premium placements, featured agency profiles, featured agent profiles, banner advertising, event sponsorships, and promotional opportunities.

Advertising products are marketing services only.

SHIFT Fiji does not guarantee:

  • Property sales.

  • Property rentals.

  • Occupancy rates.

  • Lead generation.

  • Enquiries.

  • Revenue.

  • Return on investment.

  • Search rankings.

  • Visibility levels.

  • Business growth.

Advertising fees are paid for exposure and promotional opportunities only.

10. User Generated Content

Users retain ownership of content submitted to the platform.

By submitting content, users grant SHIFT Fiji a worldwide, non-exclusive, royalty-free licence to use, reproduce, display, distribute, publish, modify, promote, and market such content in connection with the operation and promotion of the platform.

Users warrant that submitted content does not infringe the rights of any third party.

11. Prohibited Conduct

Users must not:

  • Submit false or misleading information.

  • Create fake accounts.

  • Submit fake reviews.

  • Manipulate rankings or reviews.

  • Impersonate others.

  • Upload unlawful content.

  • Harass or threaten others.

  • Infringe intellectual property rights.

  • Engage in fraudulent conduct.

  • Disrupt platform operations.

  • Attempt unauthorised access to systems.

  • Upload malicious software or code.

SHIFT Fiji may immediately remove content or suspend accounts where prohibited conduct is identified.

12. Intellectual Property

All platform content, software, logos, branding, designs, graphics, databases, text, functionality, and intellectual property remain the property of SHIFT Fiji or its licensors.

Users may not copy, reproduce, modify, distribute, sell, license, scrape, extract, or commercially exploit platform content without prior written consent.

13. Third Party Content and Links

SHIFT Fiji may contain links to third-party websites, services, businesses, or content.

SHIFT Fiji does not control or endorse third-party content and accepts no responsibility for any third-party services, products, websites, or information.

Use of third-party services is entirely at the user's own risk.

14. No Guarantees

SHIFT Fiji provides marketing, visibility, networking, and informational services only.

SHIFT Fiji does not guarantee:

  • Property sales.

  • Property rentals.

  • Occupancy.

  • Leads.

  • Enquiries.

  • Revenue.

  • Income.

  • Capital growth.

  • Rental returns.

  • Investment performance.

  • Business growth.

  • Rankings.

  • Reviews.

  • Search visibility.

  • Platform traffic.

  • Advertising performance.

Past results displayed on the platform do not guarantee future outcomes.

15. Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, SHIFT Fiji disclaims all warranties, representations, and guarantees, whether express or implied, including warranties relating to:

  • Accuracy.

  • Reliability.

  • Availability.

  • Merchantability.

  • Fitness for purpose.

  • Security.

  • Non-infringement.

  • Performance.

SHIFT Fiji does not warrant that the platform will operate uninterrupted, error-free, secure, or free from viruses or harmful components.

16. Limitation of Liability

To the fullest extent permitted by law, SHIFT Fiji, its directors, shareholders, officers, employees, contractors, affiliates, partners, and representatives shall not be liable for any:

  • Loss of profits.

  • Loss of income.

  • Loss of revenue.

  • Loss of business opportunity.

  • Loss of goodwill.

  • Loss of reputation.

  • Loss of data.

  • Business interruption.

  • Indirect loss.

  • Consequential loss.

  • Special damages.

  • Punitive damages.

This limitation applies whether arising from contract, negligence, tort, statutory duty, equity, or otherwise.

Users acknowledge that use of the platform is entirely at their own risk.

Where liability cannot legally be excluded, SHIFT Fiji's maximum liability shall not exceed the amount paid by the user to SHIFT Fiji during the twelve months immediately preceding the claim.

17. Indemnity

Users agree to indemnify, defend, and hold harmless SHIFT Fiji, its directors, shareholders, employees, contractors, affiliates, and representatives from any claims, damages, losses, costs, expenses, liabilities, penalties, proceedings, and legal fees arising from:

  • User content.

  • Listings.

  • Reviews.

  • Advertising.

  • Transactions.

  • Breaches of these Terms.

  • Violations of law.

  • Infringement of third-party rights.

18. Suspension and Termination

SHIFT Fiji may suspend, restrict, remove, or terminate any account, listing, profile, review, advertisement, ranking, or platform access at any time without prior notice where it believes such action is necessary to:

  • Protect users.

  • Prevent fraud.

  • Protect platform integrity.

  • Comply with legal obligations.

  • Reduce risk.

  • Enforce policies.

19. Force Majeure

SHIFT Fiji shall not be liable for delays, interruptions, failures, or inability to perform arising from events beyond its reasonable control including natural disasters, telecommunications failures, cyber attacks, government actions, pandemics, labour disputes, power outages, or acts of God.

20. Amendments

SHIFT Fiji may amend these Terms & Conditions at any time.

Updated versions become effective upon publication on the platform.

Continued use of the platform constitutes acceptance of any updated Terms.

21. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of Fiji.

Any dispute arising from or relating to the platform shall be subject to the exclusive jurisdiction of the Courts of Fiji.
